DELIVERY & SHIPPING POLICY

(Effective from 16th June 2025)


This Delivery & Shipping Policy (“Policy”) is hereby published and adopted by Rhythm Valley Educational and Cultural Society, a society registered under the Societies Registration Act, 1860 vide Registration No. 53145/2005, having its registered office at 145, Durga Puri Extn., Delhi - 110093 (hereinafter referred to as the “Society”, “we”, “our”, or “us”). The Society is primarily engaged in the charitable and welfare activities relating to (i) the socio-economic upliftment and skill development of women in India through educational and vocational training, and (ii) the development, promotion, and encouragement of sports culture throughout the nation.

This Policy governs all matters pertaining to the packaging, dispatch, transmission, carriage, and delivery of physical or digital items (“Goods”) supplied, distributed or otherwise made available through the Society’s website or any affiliated programme portal (hereinafter collectively referred to as the “Platform”).

1. DEFINITIONS

1.1  “User” shall mean and include any natural or juristic person who has duly registered with or availed the services of the Society through the Platform, including but not limited to participants, beneficiaries, students, donors, sponsors or programme partners.


1.2  “Goods” shall mean and include all physical items (such as study kits, sports merchandise, promotional materials) and digital items (such as certificates, e-books, modules, e-receipts) offered or delivered by the Society as part of its programmes or services.


1.3  “Carrier” shall refer to any third-party logistics provider, postal agency, or courier service provider contracted by the Society for dispatch and delivery of Goods.


1.4  “Working Day” shall mean any day excluding Sundays, and public holidays on which banks in Delhi are generally open for business.


2. SCOPE & APPLICATION


2.1  This Policy shall apply to all deliveries and shipments made by the Society on or after the effective date, unless otherwise agreed under a specific programme or written agreement.

2.2  Any modifications, addenda or special terms issued under individual projects (e.g., sports kit distribution, scholarship programme material, etc.) shall be read in consonance with and shall override this Policy to the extent of any conflict.


3. MODES OF DELIVERY

3.1 Physical Delivery

All physical Goods shall be dispatched through authorized logistics partners or postal services and shall be delivered to the address as furnished by the User at the time of enrolment or request. Deliveries are currently available within the territorial jurisdiction of the Republic of India only.

3.2 Digital Delivery

Digital Goods such as e-certificates, digital learning content, and acknowledgements shall be delivered via e-mail, downloadable links or secure access through the Platform. Such delivery shall be deemed complete upon successful transmission or availability on the registered platform profile of the User. 

4. TIMELINES & PROCESSING

4.1 The Society shall endeavor to process and dispatch all confirmed orders of physical Goods within 2 to 3 working days, subject to inventory availability and the operational capacity of the Carrier.

4.2 Digital Goods shall ordinarily be delivered within 48 hours of confirmation of eligibility or completion of the concerned programme stage.

4.3 Notwithstanding the above, all delivery timelines are indicative and subject to delay due to Force Majeure events, regulatory restrictions, technical errors, public holidays, or any act beyond the reasonable control of the Society.

5. SHIPPING CHARGES

5.1 Where Goods are distributed under any donor-supported or grant-funded welfare initiative, delivery charges, if any, shall ordinarily be borne by the Society unless expressly stated otherwise.

5.2 For paid products or specific programme materials, applicable shipping charges shall be displayed at the time of submission or checkout and must be paid in advance by the User.

5.3 Any re-shipment, remote area surcharges, expedited shipping, or special handling requirements may attract additional charges to be borne exclusively by the User.

6. RISK, TITLE & RESPONSIBILITY

6.1 Risk of damage, loss or delay in relation to physical Goods shall pass to the User upon handover of the consignment to the Carrier. For digital content, risk shall pass at the moment of successful transmission.

6.2 Title in the Goods shall vest with the Society until such time as the User has satisfied all eligibility conditions, and in the case of payable items, until full payment is received.

6.3 The Society shall not be liable for any deterioration, defect, or loss arising out of misuse, negligence, improper storage, or tampering after delivery.

7. UNDELIVERED & RETURNED ITEMS

7.1 In the event that a delivery fails due to incorrect address, recipient unavailability, or refusal to accept the package, the Carrier shall make one (1) re-attempt at delivery.

7.2 If the package remains undelivered after re-attempt and is returned to the Society, the User shall be informed and shall bear the cost of re-shipment, if re-dispatch is requested.

7.3 Unclaimed or returned Goods not collected within 30 days shall be deemed forfeited and the Society shall be entitled to reallocate or dispose of the same in a manner consistent with its charitable objectives.

8. DAMAGE OR DEFECTIVE DELIVERY

8.1 Users must inspect the contents of the delivery immediately upon receipt and shall report any damage, discrepancy, or missing item to the Society in writing within 48 hours of receipt, along with photographic or documentary proof.

8.2 Claims not submitted within the said period shall not be entertained and the delivery shall be deemed accepted.

9. LIMITATION OF LIABILITY

9.1 The Society shall not be liable for any indirect, incidental, consequential or special damages arising out of delay, mis-delivery, non-delivery, or defects in the Goods beyond the actual value thereof.

10. FORCE MAJEURE

The Society shall not be held liable for any delay or failure in the performance of its obligations under this Policy where such delay or failure is attributable to Force Majeure conditions including but not limited to acts of God, war, strikes, natural calamities, lockdowns, epidemics, disruption of logistics, government intervention or any other event beyond the reasonable control of the Society.

11. AMENDMENTS

This Policy may be revised, modified, or updated at any time at the sole discretion of the Governing Body of the Society. The revised version shall be published on the official website and shall be effective prospectively unless stated otherwise.

 12. JURISDICTION & GOVERNING LAW

This Policy shall be governed by and construed in accordance with the laws applicable within the Union of India. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the competent courts located at Karkardooma, Delhi, India.
