CANCELLATION & REFUND POLICY
(Effective 16 June 2025)
This Cancellation & Refund Policy (“Policy”) is promulgated by Rhythm Valley Educational and Cultural Society, a society registered under the Societies Registration Act, 1860 (Registration No. 53145/2005), having its registered office at 145, Durga Puri Extension, Delhi – 110093 (hereinafter referred to as the “Society”, “we”, “our” or “us”). This Policy shall be read in pari materia with the Society’s Delivery & Shipping Policy dated 16 June 2025 and governs all requests for cancellation and/or refund of monies in respect of physical or digital items, programme fees, or other consideration paid or promised through the Society’s website or affiliated programme portals (collectively, the “Platform”).
1. DEFINITIONS
1.1 “User” means any natural or juristic person who has enrolled, subscribed, donated to, or otherwise availed the Society’s programmes or Goods via the Platform, including but not limited to participants, beneficiaries, students, donors, sponsors, or programme partners.
1.2 “Goods” bears the same meaning ascribed in the Delivery & Shipping Policy and includes all physical and digital items supplied by the Society.
1.3 “Programme Fee” means any consideration (whether termed fee, price, contribution, or otherwise) remitted by a User for enrolment in a paid course, workshop, event, sports programme, or any other service offered by the Society.
1.4 “Donation” means any voluntary contribution made to the Society for its charitable objectives without expectation of quid‑pro‑quo goods or services.
1.5 “Working Day” means any day other than Sunday or a public holiday on which banks in Delhi are ordinarily open for business.
2. SCOPE & APPLICABILITY
2.1 This Policy applies to all cancellation or refund requests made on or after the Effective Date, save where a specific programme‑specific agreement expressly overrides these terms in writing.
2.2 Donations are irrevocable and non‑refundable unless the transaction constitutes a manifest error (e.g., duplicate payment) duly evidenced to the satisfaction of the Society.
3. CANCELLATION REQUESTS – PHYSICAL GOODS
3.1 A User may seek cancellation of an order for physical Goods prior to dispatch by submitting a written request to rhythmvalley@yahoo.com quoting the order reference number.
3.2 Where the cancellation request is received after dispatch, the order shall be treated in accordance with Clause 7 (Undelivered & Returned Items) of the Delivery & Shipping Policy and no cancellation shall be entertained unless:
(a) the Goods are demonstrably damaged, defective, or incorrectly supplied; and
(b) the User has complied with the inspection and notice requirements in Clause 8 of the Delivery & Shipping Policy.
3.3 Approved cancellations made prior to dispatch shall entitle the User to a full refund of the Programme Fee or purchase price (excluding any convenience charge or payment‑gateway fee, which is non‑refundable).
4. CANCELLATION REQUESTS – DIGITAL GOODS
4.1 Owing to the irrevocable nature of digital content, no cancellation or refund shall be permissible once the download link, access credential, or electronic file has been dispatched to the User.
4.2 Notwithstanding Clause 4.1, if the Society is unable to provide functional access to the digital content within the timeline stipulated in Clause 4.2 of the Delivery & Shipping Policy, the User may elect either:
(a) a pro‑rata refund of the affected portion of the Programme Fee; or
(b) a complimentary extension or replacement of the digital service, at the Society’s discretion.
5. CANCELLATION OF PROGRAMME ENROLMENT / EVENT REGISTRATION
5.1 A User wishing to withdraw from a paid course, workshop, camp or event (“Programme”) must furnish a written notice of cancellation to the Society. Refund eligibility shall be determined as follows:

*Payment‑gateway and administrative charges (up to 3 % of the Programme Fee) are non‑refundable.
5.2 Where a Participant is unable to attend due to medical emergency, bereavement, or another grave circumstance, the Society may, upon production of satisfactory documentary proof, permit (i) a one‑time transfer of enrolment to the next available session or (ii) a partial refund up to 75 %, at its sole discretion.
5.3 If the Society cancels or materially reschedules a Programme for reasons other than Force Majeure, Users shall be entitled to either:
(a) a full refund of the Programme Fee already paid; or
(b) a seat in the rescheduled Programme or equivalent offering.
6. REFUND PROCEDURE & TIMELINE
6.1 All refund requests must reference the original payment transaction ID and shall be processed only to the source account (card, wallet, or bank) used for payment, unless such account is non‑functional or closed.
6.2 Upon approval, refunds shall be initiated within ten (10) Working Days. Actual credit to the User’s account may vary according to intermediary banking cycles, for which the Society shall not be responsible.
6.3 In no event shall the Society be liable for interest, consequential losses, or exchange‑rate fluctuation on any refunded amount.
7. EXCLUSIONS
Refunds shall not be granted in the following circumstances:
· Failure to attend a physical or online session without prior written cancellation (“no‑show”).
· Inability to meet pre‑announced eligibility criteria or documentation requirements attributable to the User.
· Loss, theft, or destruction of Goods post‑delivery.
· Acts constituting misuse, negligence, or violation of programme code of conduct.
8. LIMITATION OF LIABILITY
The Society’s aggregate liability under this Policy shall not exceed the amount actually paid by the User for the specific Goods or Programme in question. The Society disclaims all indirect, incidental, or consequential damages arising from any cancellation or refund transaction.
9. FORCE MAJEURE
Where cancellation or non‑performance is directly attributable to Force Majeure (as defined in Clause 10 of the Delivery & Shipping Policy), the Society may, at its option, (i) reschedule the affected Programme, (ii) provide substitute Goods, or (iii) refund the Programme Fee subject to deduction of unrecoverable expenses.
10. AMENDMENT & MODIFICATION
This Policy may be amended at any time by resolution of the Society’s Governing Body. The updated Policy shall be posted on the Platform and shall take effect prospectively. Users are advised to review the Policy periodically.
11. GOVERNING LAW & JURISDICTION
This Policy shall be governed by the laws of India. All disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts at Karkardooma, Delhi, India.
